Regulations of Master Classes
“Wokół Chopina i Schumanna” [Around Chopin and Schumann]

hereinafter referred to as the “Regulations”

§1 Introductory provisions
1. Master Classes shall be organised by Ludwig van Beethoven Association, with its registered office in Kraków, 31-147, ul. Długa 19/4, entered to the National Court Register under number 0000174227, holding Tax Identification Number (NIP) 676-22-52-039 (the “Organiser”).
2. Master Classes constitute a paid programme under which the artists qualified by the Organiser shall participate in workshops directed by the Master specified by the Organiser.
3. The participants of the Classes may be only people who are at least 18 years old.

§2 Eliminations
1. People who want to participate in the Classes shall send materials containing a sample of their artistic performance complying with criteria in respect of repertoire, duration and format specified at the web site of the Organiser.
2. The deadline for submitting applications shall be specified at the Organiser’s web site.
3. Applications should be sent to the Organiser’s address (Ludwig van Beethoven Association, ul. Chmielna 15/10, 00-021 Warszawa, with annotation: “Master Classes – Nelson Goerner”). For recording, candidates shall be obliged to send an application the specimen of which has been attached as schedule 1 to the Regulations and is available at the Organiser’s web site (www.beethoven.org.pl) and detailed artistic biography in English.
The recording has to comply with the following standards(professional recording on a CD or DVD, lasting for at least 15 minutes, containing at least one piece of Frederic Chopin or Robert Schumann).
4. The Organiser shall choose people to be allowed to participate in the Classes from among applications complying with the aforementioned criteria.
5. The Organiser’s decision on selection of participants may not be appealed against. The Organiser shall make decisions on the basis of a subjective assessment of the applications sent and shall not be obliged to justify the same.
6. The list of participants classified to the Classes shall be announced at the Organiser’s web site within 21 days before the planned date of Classes at the latest.
7. The Recordings shall not be assessed if they fail to comply with the aforementioned requirements or are sent after the deadline specified at the Organiser’s web site.
8. The Recordings sent shall not be returned to the Participants.
9. The Organiser shall not reimburse costs of dispatch of the Recordings.

§3 Admittance to the Classes
1. Participation in the Classes is paid.
2. Participants shall be admitted to the Classes provided that:
a) they are positively assessed by the Organiser;
b) they pay for participation in the Classes.
2. Participants shall be informed about the fee for the Classes along with announcement of the list of people classified to participation in the Classes. At the same time, the Organiser shall communicate the bank account number to which payments shall be made.
3. The payment shall be made within 7 days as of the publication of the list of people classified to participation in the Classes at the Organiser’s web site.
4. If the participant fails to make payment within the period specified, the Organiser may remove his/her name from the list of participants and choose another person.
5. People classified to participation in the Classes shall be obliged to arrive at a place they are to take place at the time specified by the Organiser. Failure to arrive, even if justified, shall not justify the claim for reimbursement of the fee for participation in the Classes.
6. During the Classes, participants shall improve their skills under the eye of the Master guaranteed by the Organiser at the time specified in the announcement on organisation of particular Classes placed at the Organiser’s web site.

§4 Transfer of copyrights to the Recording
1.When sending the Recording to the Organiser, the participant transfers to the Organiser all and any copyrights to the piece contained in the Recording in respect of use, disposal and collection of benefits in the following forms of exploitation:
a)right of public performance, playing and broadcasting;
b)right of recording the piece using any technique, including digital, optic, magnetic technique, print and on photographic film;
c)right of introducing the piece to the computer memory and own data bases;
d)right of adjusting the piece to the Organiser’s requirements;
e)right of using the piece in order to promote an advertise the Organiser, Competition and Final Concert.
2. The transfer of rights referred to in sect. 1 shall not be limited by time or territory and shall be free of charge.
3. The participant consents for the Organiser to use and dispose of the rights to related pieces occurred as a result of translation, processing or adaptation of the piece referred to in §3 sect.1 clause 2 in all forms of exploitation specified in sect.1 of this article.
4. The participant shall transfer to the Organiser the right to express consent referred to in sect. 3 of this article to third parties in the forms of exploitation specified in sect. 1 of this article.

§5 Final concert
1. The second stage of the Classes shall be a Final Concert to take place at the time and pace specified by the Organiser and announced at its web site. The concert shall be recorded by the Organiser and open for public.
2. During the Final Concert, Finalists shall perform pieces specified by the Organiser. The Organiser does not guarantee that all participants will participate in the final concert.

3. The Master conducting particular Classes selected by the Organiser shall be responsible for individual assessment of each Finalist and selection of participants of the final concert.

4. Finalists shall not be entitled to remuneration for performance during the Final Concert.
5. The Organiser shall not cover costs related to the Finalists’ accommodation at the place of Classes or any transport costs incurred by them.
6. Each Finalist performing during the Final Concert shall receive a commemorative Diploma.

§6 Transfer of copyrights to the pieces
recorded during the Final Concert

The participant shall transfer to the Organiser all copyrights to the pieces recorded during the Final Concert in respect of their use and disposal and collecting benefits in all forms of exploitation as specified in §4 sect.1 of the Regulations.

§7 Organiser’s responsibility
1. The Organiser shall bear no responsibility for negative assessment of Finalists and their performance during the Classes or the Final Concert given by the Master, in particular if the assessment violates the Finalists’ personal rights. The assessment is an arbitrary and independent opinion of the Master.


§8 Final provisions
1. Any and all amendments to these Regulations require written form or else shall be null and void.
